Please read all our Terms and Conditions carefully to be sure that you understand them.
By using the Service, you are agreeing to our Terms and Conditions.
1. THIS AGREEMENT
1.1 This Agreement is made between us, Yuanfang Limited (a company registered in England under number 11144607 with its registered office at Unit 39a St Olav's Court, City Business Centre, Lower Road, London, England, SE16 2XB, trading as Homeward Express) (“Yuanfang / Homeward Express”), and you, the person who wishes to use the Services and who enters into this Agreement by accepting these Terms of Service (“you” and “your”)
2. TERMS OF SERVICE
2.1 In order to use any of the Services, you must agree to these Terms of Service. You may not use any of the Services if you do not accept these Terms of Service. Your booking and/or use of the Services will be taken as acceptance of these Terms of Service.
2.2 Yuan Fang Ltd may refuse or may cease to provide the Services where Yuan Fang Ltd considers that it is or may be used in breach of these Terms of Service or for any unlawful or improper purpose, or for any other reason.
2.3 Yuan Fang Ltd may change these Terms of Service from time to time. Yuan Fang Ltd will notify you of any changes by posting them on the Site or through other reasonable means of providing notice. Any changes to the Terms of Service will come into force on the date stated in the notice. If you use the Services after changes to the Terms of Service have come into force, you will be taken to have agreed to the changes. If you do not agree to the changes, then you may terminate this Agreement.
3. CHARGES AND PAYMENT
3.1 Unless stated otherwise on the Site, all charges are inclusive of VAT. If the rate of VAT changes, Yuan Fang Ltd may adjust the charges payable by you accordingly from the date the change takes effect.
3.2 Yuan Fang Ltd charges are payable by credit card or debit card as follows:
3.2.1 charges for Yuan Fang LTD to send you empty Storage Boxes and Packing materials will be payable when you place an order;
3.2.2 charges for the first 3 month’s storage, for Storage-by-the-box, whether the Storage Boxes are provided by you or by Yuan Fang Ltd, and any charges for additional coverage which you choose to purchase under, will be payable when you place an order;
3.2.3 for Storage-by-the-box, any outstanding charges will be payable in full when you book a return order for your Storage Containers or Other Items;
3.3 Yuanfang Limited may review the charges for Shipping Across the UK, Removals, empty Storage Containers and Packing Materials from time to time. If Yuan Fang Ltd increases the charges, the increased charges will take immediate effect for all new orders.
4. RIGHT TO WITHHOLD OR DISPOSE OF GOODS AND OTHER ITEMS IN CASE OF NON-PAYMENT
4.1 If you do not pay the charges or any other payments due under this Agreement, Yuan Fang Ltd may withhold and ultimately dispose of some or all of the Goods or Other Items. You will be responsible for all storage charges and other associated costs reasonably incurred by Yuan Fang Ltd while withholding or disposing of the Goods or Other Items.
4.2 In this case, Yuan Fang Ltd will give you 30 days’ written notice (By email, WeChat, SMS) requiring you to pay all amounts due and to contact Yuan Fang Ltd to arrange for re-delivery of the Storage Boxes or Other Items. If, upon the expiration of the 30-day notice period, you have failed to pay all of the amounts due, Yuan Fang Ltd may dispose of some or all of the Goods or Other Items by sale, gift to charity, or otherwise.
4.3 If, in Yuan Fang Ltd’s reasonable opinion, the Goods or Other Items cannot be sold for a reasonable price or at all (for any reason), or despite Yuan Fang Ltd’s reasonable efforts they remain unsold, you authorise Yuan Fang Ltd to treat them as abandoned and to destroy or otherwise dispose of them at your cost.
4.4 You shall be responsible for all costs reasonably incurred by Yuan Fang Ltd in relation to the disposal of the Goods or Other Items.
5. RESTRICTIONS
5.1 You must not and you agree that you will not, directly or indirectly:
5.1.1 use the Services in any way that is unlawful or fraudulent, or for any unlawful or fraudulent purpose or effect;
5.1.2 sub-license, re-sell or offer in any manner, to a third party, the Services or use of or access to the Services, whether for commercial gain or otherwise, unless Yuan Fang Ltd has previously agreed in writing;
5.1.3 attempt to interfere with or disrupt the Services or the Site or any server or network used by or connected to the Site or to gain unauthorised access to any such server or network;
5.1.4 contravene any of the Packaging Requirements; and/or
5.1.5 act inappropriately or aggressively towards any Yuan Fang Ltd employees, contractors, agents, or other workers or attempt to contact them (i) outside of their shift working for Yuan Fang Ltd and (ii) in connection with any matter other than the Services.
5.2 You agree that if you breach any of the restrictions, Yuan Fang Ltd may terminate this agreement immediately in accordingly and such termination does not preclude Yuan Fang Ltd from taking legal action against you, where appropriate.
6. DISCLAIMER
6.1 Yuan Fang Ltd will provide the Services with reasonable care and skill and substantially as described in this Agreement. Yuan Fang Ltd does not make any other warranties, conditions or representations about the Service and (save as expressly set out in this Agreement) Yuan Fang Ltd shall have no responsibility or liability whatsoever as bailee, custodian or guardian of the Goods or Other Items carried or stored by it.
6.2 Nothing in this Agreement affects your legal rights under the Consumer Rights Act 2015 (also known as ‘statutory rights’). You may also have other rights in law.
7. RIGHT TO CANCEL
7.1 Each booking request for a Service by you shall constitute a separate contract between you and Yuan Fang Ltd on these Terms of Service.
7.2 You have the right to change your mind and cancel each booking request for a Service up to the cut off timings set out (prior 24 hours) below without giving any reason. However, you do not have the right to cancel if you requested for us to start providing the Services during the cancellation period.
8. TERMINATION
8.1 You may terminate this Agreement at any time by requesting the return of your Storage Containers packed with your Goods or Other Items and paying any outstanding charges due to Yuan Fang Ltd.
8.2 Yuan Fang Ltd may terminate this Agreement with immediate effect by notice in writing to you, if:
8.2.1 you fail to pay any amount due, including any interest accrued, by the date due; or
8.2.2 you are in breach of any term of this Agreement.
8.3 Yuan Fang Ltd may terminate this Agreement for any reason by giving you not less than 30 days’ written notice.
8.4 Upon termination of this Agreement for any reason, you must contact Yuan Fang Ltd promptly to arrange for re-delivery of the Storage Boxes and Other Items to your nominated address.
8.5 If within 30 days following termination of this Agreement for any reason you fail to arrange for re-delivery of the Storage Boxes, then Yuan Fang Ltd may dispose of the Goods.
8.6 Termination of this Agreement will not affect our right to receive any money which you owe to us under this Agreement.
9. GOVERNING LAW
9.1 The laws of England and Wales apply to this Agreement, although if you are resident elsewhere you will retain the benefit of any mandatory protections given to you by the laws of that country.
9.2 Any disputes will be subject to the non-exclusive jurisdiction of the courts of England and Wales. This means that you can choose whether to bring a claim in the courts of England and Wales or in the courts of another part of the UK or EU Member State in which you live.
10. SERVICE SPECIFICS
10.1
You can make a booking only if you agree to all the Storage Service Process (price and charges) and terms and conditions below:
Please ensure that all the order information submit is accurate. If there is any changes, please contact customer service the day before the pickup date/delivery date no later than 17:00.
Please ensure that all items for storage are in suitable packaging / carton boxes and must be all securely sealed.
All the storage items must be safe for handling and transportation. You can purchase double wall carton box from us.
If there are any fragile items, customers must safety pack individual items to avoid any damage during handling and transportation. Our company is not liable for any damage caused by improper packing during storage or transportation.
Please ensure that you or your authorized representatives are present when the items are returned after storage. After receiving the items, please check the items carefully. If you encounter any problems, please contact customer service - cs@homewardexpress.co.uk
If your contact information has changed during the storage period, please contact customer service to update your personal detail.
If your storage time exceeds 3 months, please contact customer service to make your storage payment. (Monthly payment start from month 4). If you fail to pay within the specified time limit, you will entitle for late payment charge. Any late payments exceed for 3 months, we reserve the right to dispose of your items in storage at your expense.
If you choose a third-party delivery service, please ensure that all items are packed in a suitable carton, and ensure that there are no flammable, explosive, corrosive or other prohibited items in the box. Our company is not liable for losses or damage caused by third-party company during the delivery process. Should it happen, our company will assist you in claiming against a third-party carrier. If you have valuables to be transported, we recommend using our company's special delivery service.
